I posted this within another thread, but I thought I would give it it's own thread so y'all won't overlook it.

I had to type manually because it is a pdf document. I don't want to link to another website that Eric wouldn't approve of.(competitor)

Intergraph Case Number 07-04210125

At approximately 1:52 PM on April 21, 2007, I contacted the victim at 3315 S. Alameda (Doctor's Regional Emergency Room) in reference to a sexual assault report. When contacted, victim #1 had advised that she and suspect #1 (As of a month ago) were boyfriend and girlfriend. Victim added that suspect #1 had been in contact with her since the time of the break-up. Victim added that at approximately 2 am on April 21, 2007, suspect #1 had sent her a text message via her cell phone that he was outside of her apartment. Victim advised that she let suspect #1 into her apartment due to avoid waking up her child. Victim added that suspect #1 was intoxicated. Victim added that this led to him (suspect #1) touching and kissing each other which lated led to sexual intercourse against her will. The assault in question occured in her living room. Victim kept adding that she still loves suspect #1. Sexual assault exam requested was signed by reporting officer.

Case: 07-421125

Y'all can draw your own conclusions. In my opinion, there doesn't seem to be enough here to actually make charges. I'm waiting to see what the rape kit will reveal.

Did you not read the part about SEXUAL INTERCOURSE AGAINST HER WILL? Despite she says ""she still loves him"", you can love someone and still get raped by them. You can love your wife/girlfriend and she can love you back, but forcing someone into sex, is RAPE, and it does not matter if you love them or not.

If your wife says no to sex, but you still force yourself into her, that is rape, its domestic rape.

drop the attitude there spanky. I posted this for everyone to see the report and posted my own opinion. The report speaks for itself.

I''m glad you understand the concept of ""no means no"". That is a concept that most of us men learn at an early age.

Once again I will point out to you as I have for others. Let the investigation play out. The rape kit will hopefully fill in the blanks that the report is missing.

I just think the problem Is that he is engaged and allegedly having sex with another woman.

Secondly, shouldn''t the Chief of Police be doing things to remove people from the streets who are driving while intoxicated, or did he ride his bike to this woman''s house?

I personally like Bryan, I am a little disappointed. I don''t think he''s a rapist by any means, but I think he made some poor judgement. Just goes to show that everyone makes mistakes. I hope he comes back from vacation and continues doing what he''s been doing.

Have you ever heard of Battered Woman Syndrome? Women can be beaten, raped, sodomized, thrown down a flight of stairs, humiliated, and she will still stay with her husband/lover/boyfriend as a result of psychologically been dependent on him as well as financially for her children.

Know all about it. Those women dont call up the media and only file police reports when they are very angry (it takes the anger for them to even file). When they file they dont love the loser. After the begin to ""miss him"" then they think they ""love him"".

The girl is ate up with jealousy and this jealousy was used by the political expedient. They wanted to place the chief under the thumb. Women are the tool of power politics usually it works out more subtle and is held over the head for a favor in the future. You want to go after somebody who beats his spouse check out the divorces of some of our leading men.

You will see this was a political stunt.

He went to her place why? hmmm obviously only he knows but im sure like most men that are engaged or in a relationship with their significant other its purely for SEX he wanted it..she didnt call him he TEXT her..and shes the desperate one? NO shes the smart one for bringing this out in the open and making him think now ""what the heck did i do""..its amazing when people do things wrong and AFTER the fact they want to know WHY are you doing this to me? WHY are you letting the public know this? Unless there is a fairly copious amount of vaginal tearing indicating that the sex was most likely not consensual, this case is going to be a pretty big loser for the prosecution, regardless of whether a rape occurred or not.

First, there are only two witnesses to the alleged offense, the accuser and the accused. Second, any defense attorney worth his salt will point out that the suspect texted her that he was outside--a locked door. The victim will likely be grilled about why she just didn''t call police. Then, he will jump on the fact that she said she still loves him. By the end of her testimony, he will have the jury accepting the premise that she is a jilted woman trying to get her man back by anyway possible.

Is that the truth? We will likely never know the true answer to that. The only thing that is certain is that there is most likely a copious amount of reasonable doubt in this case.

If the alleged victim was raped, she will probably never find justice in this case. If she was not raped, Smith will most likely never clear his name, as the court of public opinion is not contricted by reasonable doubt requirements. The only winners will be the defense attorneys who will make a bundle on this case.

Is that the way it should be? No. Is that the way it is much of the time? Yes.

Should this go to trial,I will be there in a packed courtroom listening very intently to testimony by all parties. Then I will write my answer on a piece of paper,give it to a friend to hold and make/take bets on the verdict of the jury.

The end of the statement states that the sex was against her will. However, she seemed a willing participant up to that point. Unfortunately all this statement really shows is her word against his, and we still don''t know if any of this took place or not. Remember the Duke players?

Did this alleged sexual encounter occur that day? We still don''t know. That is when the report was filed but so far that is the only thing indicating that something happened that day if it did.

If the truth doesnt come out it wont be because of the attorneys,,it will be simply because of the position Bryan Smith holds in this city, Corpus Christis SUPPOSIBLY Finest are good for this prancing around with their badges and their status and KNOWING that even if the Tex Rangers look into this MOST cases are thrown out simply cause CC Finest never seem to do any wrong...they can speed and NO BIGGIE, shit when i see that i catch right up next to them showing them that if you can do it SO can I..they are little boys with a toy on their side and a toy in their pants ,,and 99.5% know it.. whats good for the goose is good for the gander

The difference is, if Bryan Smith was not in his position, this would not be headline news. If he was a welder''s helper, she probably would not have had anything to do with him in the first place. Losing a work-a-day guy would be no biggie and she would find another, easy enough.

Even the report, where she states they were kissing and touching EACH OTHER, indicates that she welcomed him. Yes, Bryan Smith is a dumbass and a lech for making the booty call, but the alleged victim opened the door. She had to know why he was there and perhaps even was glad he was there.

My guess is that she got ticked off when he went back to business as usual. The only person with no fault in this matter is the fiancee'', though I have no idea why she went before the cameras with Smith when the announcement was made. She should have given him his walking papers well before that time.

Yeah, many men are dogs, but many women are also to blame. If a man wants to stray, he doesn''t have to look far to find a skank to stray with.

some of you on the jury. Y''all have already convicted him before the investigation is over. If he is guilty, then he needs to be punished. If he is innocent, then he should be able to continue on with his work.

Keep in mind people...

Everything at this point is her word against his. Hard to convict on that. They need to be able to find physical evidence to support her case. That is why I keep stating that it will be interesting to see what the rape kit reveals. Also remember, that the rape kit can show she had sex, but it may not tell with who if there is no DNA. I hate to keep bringing this up, but remember the Duke case?

Don''t get us wrong. We agree with you. We are just wondering why six months for the rape kit results.

If I were in that position and I had nothing to hide,I would be screeming bloody murder for a poly test.

Even if he did have consenual sex with why not just come out and say so. Guess he could want his cake and eat it also.

I will not say he is guilty nor will I say he is innocent as I was not there and I do not know the facts of the investigation. I can and as many others can only form an opinion based on what is put out i9n the media. After the job No. 3 in ratings did on the pastor in Portland.I will form an opinion on the other two,

and requested that the investigation be completed sooner. Apparently the lab that will do the testing on the rape kit is understaffed and stated it would take 6 months to complete. However, a phone call to the lab has them completing it in 2-3 months.

Another thing to check is the phone record. They can check to see if the text message was sent at the time she indicates in the report. They may not be able to determine the message.

First off they could have requested to see her cell phone it would show a text message from him and the time sent they dont actually need to pull records, if she was smart she would have locked the message as evidence

First of all, six months WAS fast action from the DPS lab. Many cases take up to a year, depending upon the agency. Usually, you just get in line with all the other sex crimes. In order for this woman''s test to move up, obviously someone''s wait, perhaps that 5 year-old girl raped by an uncle, will be longer now.

Sadly, that wait will be for naught, as the defense already seems to be stipulating that sex occured. DNA will not show anything more than who made a deposit, not how forcefully said deposit was placed. There are no ""rape sperms"". There are no semen dressed as pirates boarding the undefended vagina vessel.

In other words, the DNA is actually useless in this case. Henry Garrett grandstanded by calling in a favor, and then could only cut the wait by about 1/2 to 2/3. I suppose he doesn''t pull as much weight as he thought.

Basically, the D.A. will go with her word against his to the Grand Jury. The defense will have no chance to rebut any testimony or offer their own side beyond what is allowed by the prosecution. However, once an indictment is handed down (if it happens), then the defense can go to work.

If a D.A. really wants to indict someone, it will happen. No amount of innocence will prevent it. Grand Juries can be stacked and they can also be hoodwinked. Chucky is pretty good at both.

I believe we had a certified CSI Lab @ CCPD but Skip Noe refused to Recertify it when Alvarez was running for Sheriff.

So we have no lab because of this clown.

Blame him for the next six months.

BTW he voted for a raise for himself and the Waters Group.

If the people in this city havent noticed we have NOTHING in this town..why? because of ALL the clowns on city council..all we have is the stupid beach,,,this isnt a real city..no amusements parks for our kids, no places like the Japanese Tea garden in SA..our kids have nothing...and why? Because of the close minded people, they dont want change in this city..WAKE UP people its like stagnate water..pretty disgusting..our streets are so ripped up and all they continue doing is putting a band-aid on the situation, no wonder when our kids graduate and move away, whats here to offer them? Even if there were a Lab in CC, it wouldn''t be wise to do the work on a high profile case like this locally. There would be too much room for claims of ""fixing"" the results.

I plan on moving this coming year..im in the process of informing the news stations and writing into the paper about little scandals first about a few people in this city, like some on city council that i know personally..ummm also a local news anchor about his infidelity along with all the proof that i have in my posession..just to make people squirm first...its kinda fun to see people squirm when they get themselves in hot water :) So Commonsense..poor choice of name for you..becareful who you piss off.

Hmm, it is funny that nothing is ever Timothy''s fault. It is the fault of the ""IDIOTS"" that Timbo is going to ""spill"" the beans. Funny how that less than nine hours ago she was going to stop wasting her time posting here. Yet, here she is. I suppose that is our fault, as well.

The first post or two, it was a diversion. Now, it is just pathetic. If you have those e-mails and whatever photos, send them off to whomever. I seriously doubt that anyone will care. Sure, it might cause a giggle around a watercooler or two on an otherwise achingly dull Monday morning, but it will be forgotten by lunch time.
